My ex has medicaid on our son. I have private insurance on him. She does not use my insurance at all. Is that even legal?

It is.
You need to notify both your insurance people and medicaid so that there is no mistake about your position regarding this. Send her a copy of the letter...along with copies of the information stating your child is covered.
